1. Introduction and Acceptance

1.1 By requesting a quotation, booking an appointment, or permitting commencement of any Services, the Client agrees to be bound by these Terms & Conditions in full.

1.2 These Terms & Conditions are publicly available on the Company’s website and referenced in all quotations and invoices. Continued use of the Services constitutes ongoing acceptance.

1.3 A binding agreement is formed without signature when the Client does any of the following:

  • provides verbal or written confirmation;
  • books a date or requests a service;
  • instructs the Company to proceed;
  • allows work to begin.

1.4 Any attempt by the Client to reserve rights inconsistent with these Terms is void unless expressly agreed in writing by the Company.

1.5 “Company”, “we”, “our”, and “us” refer to Lakis Apostoli, trading as T.A Damp Proofing, registered and operating in Cyprus.

2. Definitions

Chemical Damp Proofing Treatment (CDPT)

 The injection treatment performed by the Company to control rising damp in the walls identified in the quotation.

Wall Restoration Treatment (WRT)

An optional, non‑guaranteed restoration service that may be carried out by the Company or a third party. WRT is not part of the guaranteed works and serves only as the activation step under Path A.

Neutraliser Treatment

A complimentary supporting treatment applied only when the Client does not proceed with WRT (Path B). It is not part of the guaranteed works and is required solely for Guarantee activation under Path B.

Combined Guarantee Activation Notice

The document issued by the Company confirming that:

• the curing period has elapsed; and

• the applicable post‑curing step (WRT or Neutraliser) has been completed.

The Guarantee becomes active only upon issuance of this Notice.

Treated Walls

The specific walls identified in the quotation as receiving the Chemical Damp Proofing Treatment. The Guarantee applies only to these walls.

Client

Any individual or entity engaging the Company for Services, including their representatives, agents, or successors.

Services

All works provided by the Company, including CDPT, WRT (optional), Neutraliser Treatment (Path B), consultations, diagnostics, repairs, imaging assessments, and advisory guidance.

Hostile Behaviour

Any abusive, aggressive, threatening, obstructive, or inappropriate behaviour towards Company personnel.

Interpretation

If any definition conflicts with an operative clause, the operative clause prevails.

3. Quotations

3.1 Quotation Validity

CDPT quotations issued by Lakis Apostoli, trading as T.A Damp Proofing, are valid for six (6) months from the date of the consultation.

3.2 Re‑Assessment Requirement

If the Client wishes to proceed with a Chemical Damp Proofing Treatment after six (6) months from the initial consultation, a re‑assessment is required to ensure the quotation accurately reflects the current property condition and required Services.

3.3 Revised Quotation Following Re‑Assessment

If a revised quotation is required following a re‑assessment conducted after the initial consultation period, the updated quotation will include:

• a 20% increase applied to the original quoted amount; and

• the full cost of any additional wall damage or deterioration identified during the re‑assessment that was not included or foreseeable in the original quotation.

The revised quotation supersedes all previous quotations.

3.4 Use of Quotations

Quotations outline the scope and cost of Services to be delivered by T.A Damp Proofing and cannot be used as proof of property condition for third parties, including insurance companies, financial institutions, or courts. Any unauthorised use constitutes a breach of these Terms & Conditions.

3.5 VAT

All quotations are exclusive of Value Added Tax (VAT), which will be applied at the prevailing rate of nineteen percent (19%).

3.6 Acceptance of Quotation

By proceeding with any Services, the Client acknowledges and agrees to the quotation in full.

3.7 Scope of Services

The Services to be provided are those expressly set out in the agreed quotation, and invoices shall be issued strictly in accordance with the quotation.

3.8 Advisory Notes

Any recommendations or advisory notes contained within the quotation—including guidance on waterproofing, plastering, or painting—are provided for informational purposes only and do not constitute supervision, inspection, approval, certification, or acceptance of third‑party workmanship. Advisory notes do not override the mandatory conditions set out in the Guarantee.

4. On Site Consultations

4.1. The first consultation is free, except for apartment buildings or complexes, where a fee of €50 plus VAT applies.

4.2. For apartment buildings and complexes, If the Client proceeds with the outlined works, the consultation fee is deducted from the invoice.

4.3. The consultation fee is payable directly to the engineer on the day of the consultation.

4.4. Hotel consultations incur a fee of €100 plus VAT, which is deducted from the invoice if works proceed. The fee is payable on the day of the consultation, direct to the engineer.

4.5. Consultations outside the usual project areas incur a fee of €100 plus VAT, which is deducted from the invoice if works proceed. The fee is payable on the day of the consultation, direct to the engineer.

4.6. Clients must return the original business card receipt to receive the deduction. Copies, scans, or photographs are not accepted.

4.7. Any consultation cancelled with less than twenty‑four (24) hours’ notice incurs a €50 plus VAT cancellation fee.

4.8. Reassessments or additional visits require a fee of €50 plus VAT per visit.

4.9. Consultations are for property owners only. If the Client is not the owner, the owner must contact the Company directly or be present during the consultation.

4.10. Consultations for properties being purchased will only take place once ownership is legally transferred and the title deeds are registered in the Client’s name.

4.11. No written reports, assessments, or documentation regarding the property’s condition will be provided following a consultation. Any verbal comments or advisory guidance given during the consultation are general in nature and do not override, modify, or replace the mandatory conditions set out in the Quotation or the Guarantee.rements, post‑treatment instructions, Neutraliser Treatment conditions, or Wall‑Finishing Requirements stated in the quotation and Guarantee may void the Guarantee.

5. Scope of Services

5.1 Services Provided

The Company provides the following Services:

• Chemical Damp Proofing Treatments (CDPT)

• Wall Restoration Treatments (WRT)

• Neutraliser Treatments (Path B only)

• Consultations and assessments

• Property repairs and maintenance

• Imaging assessments and camera inspections

• Advisory guidance

5.2 Delivery of Services

All Services are delivered strictly in accordance with the agreed quotation. Only the works expressly listed in the quotation form part of the contract.

5.3 Variations and Additional Work

No additional work will be undertaken unless confirmed in writing by the Company. Verbal agreements do not alter the scope of works.

5.4 Consultations

Consultation fees, cancellation rules, reassessment fees, and eligibility requirements apply as stated in the Quotation section. Consultations are for property owners only. No written reports or condition assessments are provided.

5.5 Cancellations and Rescheduling

Cancellation fees, rescheduling fees, and material cost liabilities apply as follows:

If materials have already been purchased or preparatory work has begun, the Client is liable for all associated costs in addition to any applicable cancellation fees.

Cancellations or rescheduling with less than five (5) days’ notice incur a late‑notice fee equal to twenty percent (20%) of the quotation value for the re‑booked project.

Cancellations with less than forty-eight (48) hours’ notice make the Client liable for fifty percent (50%) of the quotation value.

5.6. Service Conditions
  • Imaging assessments incur a fee of forty‑five euros (€45) plus VAT.
  • Camera inspections incur a fee of sixty‑five euros (€65) plus VAT.
  • All walls scheduled for injection or repair must be free from personal belongings, furniture, and obstructions.
  • Chemical damp proofing is not offered on boundary walls, partition walls, or garden walls.
  • All work is subject to material availability and, where applicable, weather conditions.
  • Timeframes for completion are approximate and may change without notice.
  • Weather‑related delays do not entitle the Client to compensation, cancellation, or alteration of quotations.
  • Rescheduling due to weather is based on operational availability, not immediate weather improvement.
  • The Services provided are strictly those set out in the agreed quotation.
  • No additional work will be undertaken unless separately agreed in writing.
  • Verbal or informal agreements do not modify the scope of works unless confirmed in writing by the Company.
6. Client Responsibilities

6.1 Access & Working Conditions

The Client must provide safe, unobstructed access to the work area, including adequate lighting, ventilation, and utilities.

6.2 Removal of Belongings

The Client must remove personal belongings, furniture, and obstructions before work begins. The Company is not liable for damage to items not removed.

6.3 Disclosure of Property Conditions

The Client must disclose all relevant property conditions that may affect safety, timelines, or execution, including leaks, structural issues, or known defects.

6.4 Authority to Permit Works

The Client warrants that they have full legal authority to permit the works and will indemnify the Company against any claims arising from unauthorised works.

6.5 Work Area Control

The work area must remain free of occupants, pets, and distractions during working hours.

6.6 Compliance With Instructions

The Client must comply with all preparation, curing, and post‑treatment instructions. Failure to comply may void the Guarantee.

6.7 No Supervision of Third‑Party Work

The Company does not supervise, inspect, approve, or certify third‑party workmanship. Any guidance provided is advisory only.

6.8 Exclusion of Decorative & Plastering Issues

Decorative failure, paint reactions, plaster instability, or surface defects arising from:

• third‑party workmanship,

• incorrect materials,

• inadequate preparation, or

• premature painting is excluded from the Guarantee.

6.9 Ventilation Requirements

The Guarantee does not apply where cabinets, wardrobes, tiles, insulation boards, cladding, kitchen units, or any covering restricts ventilation or trap moisture against treated walls.

6.10 Wall Restoration Material Instructions – Lime Base System

Following the six‑month curing period, all wall repairs must be carried out strictly in accordance with the Company’s Wall Restoration Material Instructions – Lime Base System. Only breathable, lime‑based renovation mortar may be applied and only breathable mineral paint may be used. Instructions can be provided upon request. The Company accepts no responsibility for the Client’s or the Client’s tradesperson’s choice of materials, workmanship, or compliance with these instructions.

7. Guarantee System

7.1 Two‑Path Activation System

The Chemical Damp Proofing Guarantee becomes active only when one of the following activation paths is completed and the Combined Guarantee Activation Notice is issued.

Path A — Wall Restoration Treatment (WRT)

This path applies when the Client proceeds with the optional Wall Restoration Treatment.

  1. A curing period of approximately six (6) months must elapse after the Chemical Damp Proofing Treatment.
  2. The Wall Restoration Treatment is carried out after the curing period.
  3. No Neutraliser Treatment is required.
  4. The Guarantee activates only upon issuance of the Combined Guarantee Activation Notice.

The Wall Restoration Treatment (WRT) is a separate, non‑guaranteed service and does not form part of the guaranteed works.

Path B — Neutraliser Treatment

This path applies when the Client does not proceed with the Wall Restoration Treatment.

  1. A curing period of approximately six (6) months must elapse after the Chemical Damp Proofing Treatment.
  2. No repairs, plastering, rendering, or painting may be carried out before the Neutraliser Treatment.
  3. The Neutraliser Treatment is applied after the curing period.
  4. The Guarantee activates only upon issuance of the Combined Guarantee Activation Notice.

The Neutraliser Treatment is complimentary and does not form part of the guaranteed works.

7.2. Scope of Guarantee

The Guarantee covers:

  • Remedial re‑injection of treated walls if rising damp reoccurs.

The Guarantee does not cover:

  • Plastering, rendering, painting, or decorative reinstatement
  • Wall Restoration Treatment (WRT)
  • Third‑party workmanship
  • Reinstatement, making good, or decorative repairs
  • Removal or replacement of contaminated plaster
  • Salt‑affected plaster, hygroscopic substrates, or degraded render
  • Natural drying reactions affecting plaster, paint, tiles, or finishes
  • Hidden or concealed defects
  • Moisture ingress from external defects, plumbing leaks, or neighbouring properties
  • Condensation, poor ventilation, or atmospheric moisture
  • Structural movement, cracks, or subsidence
  • Consequential loss or associated costs

The Company’s sole obligation under the Guarantee is remedial re‑injection of the affected walls.

7.3. Conditions for Validity

The Guarantee is valid only when all the following conditions are met:

  1. One activation path (A or B) is completed.
  2. The curing period has fully elapsed.
  3. The applicable post‑curing step (WRT or Neutraliser) has been completed.
  4. The Combined Guarantee Activation Notice has been issued.
  5. Full payment has been made immediately upon issue of any invoice.
  6. No hostile behaviour has occurred.
  7. No unauthorised alterations or third‑party works compromise the treatment.
  8. Ventilation is not obstructed after treatment.
  9. The property is maintained in a condition that prevents moisture ingress.

Failure to meet any of the above conditions voids the Guarantee with immediate effect.

7.4. Exclusions

The Guarantee does not apply where issues arise from, but are not limited to:

External defects and penetrating damp, including and not limited to:

• cracked or hollow external render

• missing or damaged waterproof coatings

• defective gutters or downpipes

• overflowing gutters

• roof leaks

• gaps around windows or doors

• cracks in the wall structure

• unsealed joints

• damaged parapet walls

• defective flashing

• leaking balconies or terraces

• water entering from a neighbouring property

• poor external drainage

• water pooling against the wall

• high external ground levels or landscaping bridging the DPC

Other exclusions:

• structural movement, cracks, or subsidence

• defective plumbing, leaks, or burst pipes

• condensation, poor ventilation, or atmospheric moisture

• hidden or concealed defects

• decorative failure, paint reactions, or plaster instability

• premature repairs or painting

  • cabinets, wardrobes, tiles, insulation boards, cladding, or coverings that restrict ventilation

7.5. Property Maintenance Requirement

The effectiveness of the Chemical Damp Proofing Treatment depends on the Client maintaining the property in a condition that prevents moisture ingress. The Guarantee is void where lack of maintenance contributes to dampness, staining, salt migration, or deterioration. The Client must ensure:

  • Gutters, downpipes, and drainage systems are kept clear and in working order
  • Plumbing leaks, burst pipes, or internal water sources are repaired promptly
  • Adequate ventilation is maintained throughout the property
  • External ground levels or landscaping do not bridge the damp proof course
  • Structural cracks or defects are repaired without delay
  • Coverings, installations, or fixtures do not trap moisture against treated walls

Where failure to maintain the property allows moisture to enter, accumulate, or remain within the structure, such effects fall outside the scope of the Guarantee.

8. Behaviour & Conduct

8.1 Zero‑Tolerance Policy

The Company operates a strict zero‑tolerance policy towards hostile behaviour.

8.2 Definition of Hostile Behaviour

Hostile behaviour includes, but is not limited to:

• verbal abuse, shouting, or aggressive language

• threats, intimidation, or harassment

• obstructive, disruptive, or confrontational conduct

• refusal to allow safe working conditions

• unreasonable demands or behaviour that prevents normal service delivery

8.3 Right to Withdraw Services

The Company may immediately withdraw from the property and cease all Services where hostile behaviour occurs.

8.4 Automatic Void of Guarantee

Any hostile behaviour voids the Guarantee with immediate effect, regardless of treatment stage, activation status, or payment status.

8.5 No Refunds or Compensation

Where Services are terminated due to hostile behaviour, no refunds, compensation, or reinstatement of the Guarantee will be provided.

8.6 Protection of Personnel

The Client is responsible for ensuring that all persons present at the property behave appropriately towards Company personnel.

9. Financial Terms

9.1 Chemical Damp Proofing Treatments (CDPT)

Full payment is due upon completion of the Chemical Damp Proofing Treatment during the initial visit. If an invoice is issued, whether at the time of completion or afterwards, payment is due immediately.

9.2 Non‑Injection Works

For non‑injection works, payment shall be made on the day of completion, unless alternative terms have been agreed in writing. Where an invoice is issued, whether as part payment before completion or after the works are completed, payment is due immediately.

9.3 Immediate Payment Requirement

Payment is due immediately upon receipt of any invoice issued by the Company, whether delivered electronically or otherwise.

9.4 Non‑Itemised Invoices

Invoices are not itemised. The quotation governs all descriptions, quantities, and inclusions.

9.5 Chargebacks

Any chargeback without lawful grounds voids the Guarantee in full.

9.6 Non‑Payment

Failure to pay any invoice immediately voids the Guarantee, even if payment is made later.

9.7 Late Payment & Interest

  • The Client is solely responsible for monitoring the contact details they provide; failure to do so does not delay, suspend, or reduce any payment obligation.provide are advisory only and do not create any responsibility, liability, or duty of supervision.
  • Payment obligations are not affected by the Client’s personal circumstances, including illness, hospitalisation, travel, unavailability, or failure to read or access email.
  • An invoice is deemed received by the Client at the moment it is sent by the Company, whether by email, SMS, messaging application, or any other communication method provided by the Client.
  • Any overdue amount shall accrue interest from the first day it becomes late, calculated at the statutory rate applicable in the Republic of Cyprus, being the European Central Bank (ECB) base rate plus eight percent (8%).
  • Interest accrues daily until full payment is received.
  • The Company is under no obligation to grant extensions or accept delays unless expressly agreed in writing

9.8 Legal Correspondence & Recovery Costs

If the Client fails to pay any invoice when due, the Client shall be liable for all reasonable and proportionate costs incurred by the Provider in recovering the outstanding amount.

Where the Client is a business, such costs may include fees charged by the Provider’s lawyer for issuing correspondence, notices, demands, or other communications directly related to recovering the unpaid invoice. These costs shall be itemised, invoiced to the Client, and payable upon receipt.

Where the Client is a consumer, the Provider may recover only those costs permitted under applicable consumer‑protection legislation, and any such costs shall be lawful, proportionate, and clearly itemised.

The Client is responsible for reading and understanding the Guarantee before accepting any quotation or proceeding with works.

Unauthorised modification or alteration of this document voids all guarantees.

10. Legal & Compliance

10.1 Governing Law

These Terms & Conditions are governed by the laws of the Republic of Cyprus. Any dispute shall be subject to the exclusive jurisdiction of the Cyprus courts.

10.2 Limitation of Liability

The Company’s total liability is strictly limited to the cost of remedial re‑injection of the treated walls. The Company is not liable for:

• consequential loss

• indirect loss

• loss of use

• loss of enjoyment

• alternative accommodation

• damage arising from external defects, hidden defects, or third‑party works

10.3 Force Majeure

The Company is not liable for delays, cancellations, or failure to perform due to events beyond its control, including but not limited to:

• extreme weather

• supply shortages

• illness

• equipment failure

• access restrictions

• safety concerns

10.4 No Variation Without Written Agreement

No verbal statements, promises, or representations alter these Terms. Any variation must be expressly agreed in writing by the Company.

10.5 Entire Agreement

These Terms, together with the quotation and the Guarantee, form the entire agreement between the parties and supersede all prior discussions or understandings.

10.6 Severability

If any clause is found unenforceable, the remaining clauses remain in full force and effect.

10.7 Compliance With Instructions

Failure to follow the Company’s instructions, including curing, ventilation, and post‑treatment requirements, voids the Guarantee.

10.8 Third‑Party Rights

No third party has any rights under these Terms.

10.9 Copyright

All website content is protected by copyright.

10.10 Data Protection

Personal data is processed in accordance with GDPR and the Company’s Privacy Policy.

10.11 Third‑Party Links

Third‑party website links are accessed at the Client’s own risk.

10.12 Amendments

The Company may amend these Terms with notice via the website.

10.13 Authoritative Version

The Terms & Conditions and Guarantee Terms published on the Company’s official website constitute the sole authoritative and legally binding version. Any printed, forwarded, cached, archived, or third‑party copies are expressly excluded and hold no legal effect. Only the version published on the Company’s website at the time of access governs the Client’s rights and obligations.

11. Product Disclosure Policy – Damp Proofing Treatments

11.1 Professional‑Grade Materials The Company uses professional‑grade damp proofing cream or fluid (DPC) formulated for masonry injection.

11.2 Confidentiality of Proprietary Information To protect supplier confidentiality, trade secrets, and quality control, the Company does not disclose proprietary product brands, formulations, supplier identities, application methods, or technical procedures. Only the general treatment type may be confirmed.

11.3 Prohibited Requests Any attempt to compel disclosure of proprietary information, including product names, formulations, or application methods, constitutes a breach of these Terms & Conditions.

11.4 Misuse or Disclosure Unauthorised use, disclosure, or misrepresentation of product information voids the Guarantee with immediate effect.

11.5 Scope of Policy This policy applies to all queries relating to product sourcing, formulation, materials, or procedures. The Company’s intellectual property, methods, and materials remain strictly confidential.
